第一章 总 则
Chapter 1 General Rules
第一条 为严格考试管理，严肃考风考纪，加强学风建设，按照“公开公平、合法适当”的原则，依据教育部《普通高等学校学生管理规定》和《西南石油大学学生管理办法》等有关规定及有关法律法规，制订本办法。
Article 1 The Measures are specially formulated in the principle of "openness, fairness, legality and appropriateness" according to relevant provisions of the Common University Student Management Rules released by the Ministry of Education, Management Measures for Students of Southwest Petroleum University and relevant laws and regulations to enhance the exam management, exam style and discipline, and construction of study style.
第二条 本办法所称考试违纪是指学生不遵守学校的考场纪律，不服从考试工作人员的安排与要求的行为；考试作弊是指违背考试公平、公正的原则，以不正当手段获得或者试图获得试题答案、考试成绩的行为。
Article 2 The disciplinary violations in exam referred to in the Measures mean the students' failure to abide by the exam disciplines of the university and follow the arrangements and requirements of the exam staff; Cheating in examinations refers to the act of obtaining or attempting to obtain the answers and results of examinations by improper means in violation of the principles of fairness and fairness in examinations.
第三条 本办法适用于由学校组织或承办的面向西南石油大学全日制普通高等教育学生的各种考试。在校学生校外参加由国家行政部门或其它高等学校组织的各级各类考试中出现的考试违纪、作弊行为，参照本办法执行。
Article 3 These Measures are applicable to all exams for full-time general higher education students of Southwest Petroleum University organized or undertaken by the university. The disciplinary violation or cheating behaviors of the students found in exams of various levels and types organized by the national administrative departments or other institutions of higher education outside the university shall be subject to the Measures.
第四条 按照学生考试违纪、作弊行为的性质和过错的严重程度，处分种类分为：
Article 4 According to the nature and severity of the student's disciplinary violation or cheating behavior in the exam, punishments are divided into:
1、警告；
Warning;
2、严重警告；
Serious warning;
3、记过；
Record of demerit;
4、留校察看；
Academic probation;
5、开除学籍。
Expulsion.
第五条 除开除学籍外，给予学生的处分设置6至12个月期限，其中警告、严重警告处分期为6个月，记过处分期为9个月，留校察看处分期限为12个月。违纪、作弊行为发生后能主动配合调查、及时深刻认识错误的，可视情节酌情缩短处分期限，但留校察看不得少于9个月，其他处分不得少于6个月。处分期满后的处分解除办法及程序按《西南石油大学学生违纪处分办法》执行。
Article 5 A period of 6 to 12 months is set for punishments given to the students except for expulsion. The punishment period is 6 months for a warning or serious warning, 9 months for record of a demerit, and 12 months for an academic probation. The punishment period can be shortened according to the circumstances if the students can actively cooperate with the investigation and deeply understand the mistakes in a timely manner after the disciplinary violation or cheating behavior, but it shall be not less than 9 months for an academic probation and not less than 6 months for other punishments. The methods and procedures for the termination upon the expiration of the punishment period shall be implemented in accordance with the Measures for Punishment of Disciplinary Violations of Students of Southwest Petroleum University.
第六条 学生在校期间考试违纪、作弊累计达到三次的给予开除学籍处分；受留校察看处分期间再次考试违纪、作弊的，给予开除学籍处分。
Article 6 In case of accumulatively three disciplinary violation and cheating behaviors in exams in the school period, the student shall be dismissed from school; in case of a disciplinary violation or cheating behavior in the punishment period for an academic probation, the student shall be dismissed from school.
第七条 结业生在返校换证考试中，如有违纪、作弊行为，该科成绩无效，取消其以后一切与换证相关的考试资格。学生以违纪、作弊行为违规获得考试成绩并已由此取得学历证书、学位证书的，学校宣布其证书无效，责令其交回证书并由学校予以撤销。
Article 7 In case of a disciplinary violation or cheating behavior in the exam where graduates take to obtain the graduation certificates, the scores of the involved student in the subject will become invalid and the student will be disqualified for all exams related to the graduation certificate. If a student obtained an exam result by violating discipline or cheating, and has thereby obtained an academic certificate or a degree certificate, the university will declare the certificate as invalid, order it to be returned and then have it revoked.
第二章 考试违纪处理
Chapter 2 Handling of Disciplinary Violations in Exams
第八条 有下列一般考试违纪情形之一的，取消考试资格，该科成绩无效（记为“违纪”），并给予警告处分。
Article 8 Any who commits any of the following general disciplinary violations in exams shall be disqualified from such exam with invalid results (recorded as "violation of discipline"), and shall be given a warning for punishment.
1、 考试中擅自改换座位或座位号；
Changing the seat or seat number without authorization during the exam;
2、考试过程中擅自互传考试用具（笔、尺、计算器等）；
Exchanging the exam appliances (such as pen, ruler, calculator) without authorization during the exam;
3、开考信号发出前提前答卷，或考试终了信号发出后继续答卷；
Answering before the exam start signal is sent, or continuing to answer after the exam end signal is sent;
4、口试抽签后，未到指定地点答题；
Failing to answer at the designated place after drawing for the oral test;
5、其它一般考试违纪行为。
Having other general disciplinary violations in exams.
第九条 有下列较严重考试违纪情形之一的，取消考试资格，该科成绩无效（记为“违纪”），并给予严重警告处分。
Article 9 Any who commits any of the following relatively serous disciplinary violations in exams shall be disqualified from such exam with invalid results (recorded as "violation of discipline"), and shall be given a serious warning for punishment.
1、不按规定就座，且拒不听从监考人员劝告或安排；
Failing to seat as required, and refusing to follow the advice or arrangement of the invigilator;
2、正式开考前，不按要求将考试禁止携带的书包、文具用品或与考试有关的物品（如教材、参考资料、通讯设备、具有存储功能的电子设备等）放置到指定地点；
Failing to place the school bags, stationery, or items related to the exam (such as teaching materials, reference materials, communication equipment, electronic devices with storage functions) that are prohibited in exams to the designated place as required before the official start of the exam;
3、考试中，考试工作人员对考试证件、身份等提出质疑，学生拒不配合；
Refusing to cooperate when the exam staff questions the exam document, identity, etc. during an exam;
4、在考场内大声喧哗、吸烟，或有其它影响考场秩序的行为，经劝阻不改；
Making loud noises, smoking or having other behaviors that affect the order of the exam room in the exam room, and refusing to correct after being discouraged;
5、提前交卷后，在考场附近逗留、交谈，影响他人考试，经劝阻不改；
Staying and talking near the exam room after assignment in advance, affecting others' exams, and refusing to correct after being discouraged;
6、考试结束信号发出后，监考人员未收齐试题或答卷时，擅自离开考场；
Leaving the exam room arbitrarily before the invigilator collects all the papers or sheets after the exam end signal is sent;
7、伪造证明材料申请缓考；
Forging proof materials to apply for a delayed exam;
8、其它较严重考试违纪行为。
Other relatively serious disciplinary violations in exams.
第十条 有下列严重考试违纪情形之一的，取消考试资格，该科成绩无效（记为“违纪”），并给予记过处分。
Article 10 Any who commits any of the following serious disciplinary violations in exams shall be disqualified from such exam with invalid results (recorded as "violation of discipline"), and shall be given a demerit for punishment.
1、隐卷不交或将试卷（包括答题卡、答题纸等，下同）带出考场，但能在一小时内主动交回；
Hiding test papers or not handing them in or taking them (including answer sheets and papers, the same below) out of the examination room, yet returning them within one hour voluntarily;
2、未到规定允许交卷时间而强行交卷离开考场；
Handing in test papers and leaving the examination room before due time;
3、用规定以外的笔或纸答题、在试卷规定以外的地方书写姓名、考号等或以其它方式在答卷上标记、书写特殊信息；
Writing their names, examination numbers, etc., or marking or writing special information on the answer sheets or other areas with a pen not as required;
4、其它严重考试违纪行为。
Other serious disciplinary violations in exams.
第十一条 有下列特别严重考试违纪情形之一的，取消考试资格，该科成绩无效（记为“违纪”），并视情节给予留校察看或开除学籍处分。
Article 11 Any who commits any of following extremely serious disciplinary violations in exams shall be disqualified from such exam with invalid results (recorded as "violation of discipline"), and shall be given a punishment of academic probation or expulsion according to the circumstances.
1、 考试中被查实携带手机等通讯设备，尚未构成作弊的；
Carrying communication devices such as mobile phones to the exam, which has been verified but not constituted cheating yet;
2、考试期间故意损毁试卷；
Damaging the test papers deliberately during exams;
3、隐卷不交或将试卷带出考场，且未能在一小时内主动交回；
Hiding test papers to not hand them in or taking them out of the examination room, and failing to return them within one hour;
4、在试卷上书写谩骂、侮辱性语言；
Writing abusive and insulting remarks on test papers;
5、无理取闹，严重干扰监考教师执行考务或有其它严重妨碍考试工作人员履行职责的行为；
Making troubles without reason, interfering with the duty performance of invigilators during exams, or hindering the examination staff from performing their duties;
6、干扰考试评卷工作，纠缠、威胁、诬陷、贿赂评卷教师或考试工作人员；
Interfering with the exam evaluation, or pestering, threatening, framing or bribing evaluation teachers or examination staff;
7、在第八条、第九条、第十条所列情形之下，不服处理，干扰考场，肆意纠缠、威胁或公然侮辱、诽谤、诬陷监考人员；
Refusing to obey the handling as listed in Article 8, Article 9 and Article 10, interfering in exams, and pestering, threatening, insulting, libeling or framing invigilators in a reckless and open way;
8、其它特别严重考试违纪行为。
Other extremely serious disciplinary violations in exams.
第三章 考试作弊处理
Chapter 3 Handling of Cheating on Exams
第十二条 有下列考试作弊情形之一的，取消考试资格，该科成绩无效（记为“舞弊”），并给予记过处分。
Article 12 Any who commits any of the following cheating behaviors on exams shall be disqualified from such exam with invalid results (recorded as "violation of cheating"), and shall be given a demerit for punishment.
1、窥视他人答卷或有意让他人窥视、抄袭答卷；
Peeping the answer sheets of others or intentionally allowing others to peep or copy the answers;
2、互对答案、与他人交谈有关考试内容；
Checking answers with each other or discussing the exam contents during exams;
3、互打暗号、手势传递试卷及答案信息；
Passing test papers and giving answers by secret signals or gestures;
4、提前交卷后，有意在考场内或考场附近逗留，借机向考场内考生透露试题答案；
Staying in or near the examination room after handing in test paper and taking the opportunity to give answers to the students still in the examination room;
5、其它一般考试作弊行为。
Cheating in other general forms.
第十三条 有下列严重考试作弊情形之一的，取消考试资格，该科成绩无效（记为“舞弊”），并给予留校察看处分。
Article 13 Any who commits any of the following serious cheating behaviors on exams shall be disqualified from such exam with invalid results (recorded as "violation of cheating"), and shall be given a punishment of academic probation.
1、以各种形式夹带、隐写与考试课程有关的内容。包括但不限于以下情形之一：
Bringing and writing information or contents related to the exam secretly in various forms, including but not limited to any of the cases specified as follows:
（1）开考后，在书桌内、书桌上、座位旁、考生身上以及其他可以观看或接触到的地方写有或者放有与考试课程有关的资料或纸条；
There are information or notes related to the exam written or placed in somewhere that can be seen or touched by students once an examination starts, such as in and on desks, beside the seats or on the students;
（2）在试卷中夹有或试卷下垫有与考试课程有关的资料或纸条；
There are information or notes related to the exam hid in or under the test papers;
（3）在文具盒、笔袋、允许携带的证件、计算器等考试用品中有与考试课程有关的资料或纸条；
There are information or notes related to the exam hid in test items, such as pencil case, pen bag, certificate allowed, calculator, etc.;
2、抢夺、窃取他人试卷、答卷或者胁迫他人为自己抄袭提供方便；
Robbing or stealing others' test papers or answer sheets or coercing others to provide convenience for them to copy answers;
3、他人强拿自己的试卷、答卷、草稿纸等未及时向监考人员报告；
Failing to report to the invigilator in time when being forced to give their own test papers, answer sheets and scratch papers to others;
4、传递、交换试卷、答卷、草稿纸、纸条；
Passing and exchanging test papers, answer sheets, scratch papers and notes;
5、利用上厕所之机或谎称其它理由离开考场，偷看与考试有关的内容；
Taking excuses to peep materials related to exams, such as going to the restroom;
6、通过伪造证件、证明、档案及其他材料非法获得考试资格和考试成绩，事后查实的；
Obtaining examination qualifications and results illegally by forging such materials as certificates, proofs and files, which has been verified afterwards;
7、根据试卷卷面答题内容，阅卷教师发现，经教务部门审核确认属试卷雷同、抄袭等行为；
Being deemed to commit cheating by evaluation teachers according to the answer information on the test papers, and then verified and confirmed by the academic affairs department;
8、勾结考试工作人员协助其实施作弊；
Colluding with examination staff to assist them in cheating;
9、其它严重考试作弊行为。
Other serious cheating behaviors.
第十四条 有下列特别严重考试作弊情形之一的，取消考试资格，该科成绩无效（记为“舞弊”），并给予开除学籍处分。
Article 14 Any who commits any of following extremely serious cheating behaviors on exams shall be disqualified from such exam with invalid results (recorded as "violation of cheating"), and shall be given a punishment of expulsion.
1、代替他人或让他人代替自己参加考试；
Taking the exam in the place of others or having others take the exam in their places;
2、在答卷上故意填写与本人身份不符的姓名、考号等信息；
Filling in information, such as name and examination number, inconsistent with his/her own identity on the answer sheet intentionally;
3、使用通讯设备或其他器材作弊，包括但不限于对试卷拍照、录像，发送、接收、搜索与考试有关的内容等；
Using communication devices or other devices to cheat in an exam, including but not limited to photographing and recording the test paper, sending, receiving and searching contents related to the test;
4、使用通讯设备协助他人作弊；
Using communication devices to assist others to cheat in an exam;
5、组织作弊；
Organizing cheating in an exam;
6、向他人出售考试试题或答案牟取利益；
Selling test contents or answers to others for benefits;
7、已构成考试作弊，不配合调查处理，肆意纠缠、威胁、侮辱、诽谤、诬陷监考人员；
Committing a cheating in an exam, but refusing to coordinate with investigation and handling, tangling, threatening, insulting, slandering or framing the invigilator;
8、其它特别严重考试作弊行为。
Other particularly serious cases associated with violation or cheating.
第四章 考试违纪、作弊处理程序
Chapter 4 Violation and Cheating Handling Procedure
第十五条 在考试过程中，一旦发生学生违纪、作弊行为，监考人员要按照以下程序及时处理。
Article 15 In an exam, in case of any violation or cheating behavior, the invigilator shall promptly handle it as per the following procedures.
1、监考人员应立即终止该生考试，当场收缴、保存有关证据材料，对于考生用于作弊的个人物品等予以暂扣，并及时报告考试组织单位，同时如实填写《西南石油大学考生违纪、作弊记录》及试卷袋上相关内容。《西南石油大学考生违纪、作弊记录》是认定考生违纪作弊事实的依据，须由两名及以上监考人员或考场巡视人员签字确认。
The invigilator shall immediately terminate this student's test, collect and keep relevant evidences, temporarily seize the personal articles of the student used for cheating, report to the exam organizer in time, and truthfully fill the Students' Violation and Cheating Records of Southwest Petroleum University and relevant contents on the test paper bag. The Records is the basis to affirm the violation and cheating fact of the student, which should be confirmed and signed by two or more invigilators or the exam inspectors.
2、要求考生如实填写《西南石油大学考生违纪、作弊情况自述》。考生拒绝填表的，由监考教师说明情况，并由巡考人员签字见证。
The invigilator shall ask the student to fill the Self-report for Violation and Cheating of Southwest Petroleum University. In case that the student refuse to fill in the Report, the invigilator shall give an explanation and the exam inspector shall sign for witnessing.
3、监考人员将填写好的《西南石油大学考生违纪、作弊记录》、《西南石油大学考生违纪、作弊情况自述》、学生试卷及作弊证据等材料送交考试组织单位。
The invigilator shall then submit the Students' Violation and Cheating Records of Southwest Petroleum University, the Self-report for Violation and Cheating of Southwest Petroleum University, the student's test paper, the cheating evidences and other materials to the exam organizer.
第十六条 对于考试违纪、作弊的学生，由教务处或研究生院会同有关学院在五个工作日内按本办法做出书面处理决定，情况复杂疑难的，经主管校领导同意，可适当延长时间。应给予开除学籍处分的，由教务处或研究生院提出处理意见经校长会议（包括校长办公会或校长授权的专门会议）研究决定。
Article 16 For the students in violation of the disciplines or cheating in the exams, the Office of Academic Affairs or the Graduate School shall make a written decision on handling jointly with the schools concerned within five working days in line with the Measures. In case of a complicated case, the time limit can be prolonged appropriately upon approval of the leaders in charge. In the case involving expulsion from academic status, the Office of Academic Affairs or the Graduate School shall propose the handling opinions, and the decision should be made after study on the meeting attended by the presidents (including the president office meeting or the special meeting authorized by the presidents).
第十七条 学生考试违纪、作弊的最后处理决定由主管学生工作的校领导签发，由学院直接送达学生本人；学生拒绝签收的，学院以留置方式送达，但须邀请教师代表1人、学生代表2人到场见证，并由送达人、见证人在处分送达书上签名；已离校的，采取邮寄方式送达；难于联系的，由学生所在学院通过学校网站以公告方式送达，公告期为7日，期满视为送达。对未成年人的处分决定同时送达其监护人。
Article 17 The ultimate handling decision for students' violation or cheating should be signed and issued by the leader in charge of students' affairs and be directly delivered to the student by the school. In case the student refuses to sign, it may be delivered by means of a lien, but 1 teacher representative and 2 student representatives shall be invited to be present to witness, and the delivery person and witnesses shall sign on the punishment delivery letter. In the case the student has left the university, the letter shall be delivered by mail, and in case it is of difficulty to contact the student, it shall be delivered by the school that the student was enrolled in by means of a 7 day's public notice on the university website and shall be deemed to be delivered upon the expiration. With regard to punishment decision for a minor student, the letter shall be delivered to his/her guardians.
第十八条 学生的处分及解除处分材料，由学生档案管理部门负责真实完整地归入学校文书档案、学生本人档案和大学生诚信档案，并取消其处分期限内各类评优、评奖资格等。
Article 18 The Student Archives Management Department shall truthfully and completely include the punishment and punishment termination materials of the students into the university's documentary archives, the student's own archives and the college student's integrity archives, and cancel his/her qualification for various award appraisal and evaluation within the punishing period.
第十九条 学生对学校的处分不服的，按《西南石油大学学生申诉处理办法》办理。
Article 19 The case that the students have objections to the decision on punishment shall be handled in accordance with the Management Measures for Appeal Settlement of Students of Southwest Petroleum University.
第二十条 考生的违纪、作弊行为违反《中华人民共和国治安管理处罚法》的，由公安机关进行处理；构成犯罪的，由有关部门依法追究刑事责任。
Article 20 The case that the students' violation and cheating have violated the China Public Order Management and Punishment Law shall be handled by the public security organ. In a serious case involving a crime, criminal liability will be investigated by relevant authorities.
第五章 附 则
Chapter 5 Supplementary Provisions
第二十一条 校外人员涉及本校学生考试违纪、作弊的，学校记录其违纪、作弊行为，公开其个人基本信息，并由学校出具公函，建议其所在单位给予相应处分。
Article 21 In case the student's violation or cheating involves off-campus persons, the university shall record their violation and cheating conducts, disclose their basic personal information and issue an official letter to their working units and propose corresponding punishment.
第二十二条 本办法根据原《西南石油大学学生考试违纪、作弊处理条例》（西南石大教〔2016〕101号）修订，自2017年9月1日起施行，由教务处和研究生院负责解释，凡与本办法有冲突的一律以本办法为准。
Article 22 The Measures are revised in accordance with the Handling Regulations of Southwest Petroleum University for Disciplinary Violations and Cheating of Students in Exams (XNSDJ [2016] No. 101, which were implemented since September 1, 2017 and are interpreted by the Office of Academic Affairs and the Graduate School. In case of inconsistency with the Measures, the Measures shall prevail.
